US Judge Mandates Release of Abrego Garcia from ICE Custody
A court has ruled the prompt release of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing detainment lacks legal authority.
"Since Abrego Garcia's release after wrongful detention in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis stated in her ruling.
The case stems from a erroneous removal to El Salvador in March, which US authorities later admitted was an mistake. Following his return to the United States to face alien smuggling allegations, he was held in immigration custody.
In her decision, the court pointed out that the government does not have a current removal order, which effectively blocks them from removing Mr. Abrego Garcia "at this juncture."
Context of the Case
The legal proceedings center on conflicting assertions. While the former administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently disputes this allegation.
He has also pleaded not guilty to the smuggling charges, which are part of a ongoing criminal case in Tennessee.
Terms of Release
The judge, who was overseeing his challenge to removal in a federal court, ruled that he must now adhere to the terms of his release from custody in Tennessee. This decision shifts his supervision to the Tennessee court.
This ruling marks a significant turn in a complex legal case involving allegations of wrongful detention and contested gang associations.
